1. Acceptance
By accessing or using AVICORE ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms form a binding agreement between you and AVICORE Aviation Technologies Ltd ("AVICORE", "we", "us").
2. Description of service
AVICORE provides an aviation intelligence platform including airstrip safety data, community pilot reports, a digital pilot passport, weather overlays, an aviation map and related services ("Services"). The Platform is designed to support — not replace — professional pilot judgement and official pre-flight planning obligations.
3. Eligibility
You must:
- Be at least 18 years of age.
- Be a licensed pilot, aviation professional, or a person with a legitimate professional interest in aviation operations.
- Provide accurate account information and keep it current.
4. Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at
security@avicore.co.ke if you suspect unauthorised access.
5. Acceptable use
You agree not to:
- Submit false, misleading or fabricated airstrip or safety reports.
- Use the Platform for any unlawful purpose or in violation of applicable aviation regulations (including KCAA requirements).
- Attempt to gain unauthorised access to the Platform or its underlying infrastructure.
- Scrape, harvest or systematically extract data without our written consent.
- Resell, sublicense or commercially exploit the Platform without a written agreement.
- Harass, threaten or harm other users.
6. Community reporting
Reports you submit must be accurate to the best of your knowledge. You grant AVICORE a perpetual, royalty-free, worldwide licence to use, display, aggregate and anonymise your reports to improve the safety network. Submissions that are demonstrably false or malicious may result in account suspension.
Safety disclaimer: community reports are crowdsourced and unverified. Always cross-check with official sources (NOTAM, AIS Kenya) before flight. AVICORE is not liable for operational decisions made on the basis of community data.
7. Pilot Passport data
You are responsible for the accuracy of licence, rating and logbook data you enter. AVICORE does not verify credentials with KCAA or any authority unless a future verification integration is explicitly noted as active. Do not rely solely on AVICORE records for regulatory compliance.
8. Intellectual property
All Platform software, design, trademarks ("AVICORE") and original content are owned by or licensed to AVICORE Aviation Technologies Ltd. You may not copy, reproduce, distribute or create derivative works without our written permission. User-submitted content remains your property; you grant us the licence described in clause 6.
9. Subscription and payment
Paid plans ("Subscriptions") are billed monthly or annually as selected at checkout. Prices are displayed in USD and may be subject to local taxes. Subscriptions renew automatically; cancel at any time from Account Settings. Refunds are issued at our discretion for unused billing periods.
Failure to pay may result in downgrade to a free tier or account suspension after a grace period of 14 days.
10. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.
Aviation safety critical notice: AVICORE data (weather, safety scores, airstrip conditions) is for situational awareness only. It does not constitute an official weather service, a certified chart, or an ATC clearance. Pilots retain full legal responsibility for pre-flight planning and all in-flight decisions. Never substitute AVICORE data for an official preflight weather briefing or NOTAM check.
11. Limitation of liability
To the maximum extent permitted by Kenyan law, AVICORE shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of life or bodily injury, arising from use of or inability to use the Platform. Our aggregate liability for direct damages shall not exceed the amount you paid for the Services in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend and hold harmless AVICORE, its officers, directors and employees from any claim, damage, loss or expense (including reasonable legal fees) arising from your use of the Platform, your submitted content, or your violation of these Terms.
13. Termination
We may suspend or terminate your account for breach of these Terms, with or without notice. You may delete your account at any time from Account Settings. On termination, your right to use the Platform ceases immediately.
14. Governing law and disputes
These Terms are governed by the laws of Kenya. Any dispute shall first be referred to good-faith mediation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
15. Changes to these Terms
We may update these Terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
